1. Definitions

This Data Processing Agreement ("DPA") forms part of the Terms of Service between VibeCoding Academy ("Processor") and the customer ("Controller") for the provision of services.

2. Scope and Applicability

This DPA applies to the processing of personal data by the Processor on behalf of the Controller in connection with the services provided under the Terms of Service.

3. Data Processing

The Processor shall process personal data only on documented instructions from the Controller, including with regard to transfers of personal data to a third country or an international organization.

4. Security Measures

The Processor shall implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, pseudonymization, and regular security testing.

5. Sub-Processors

The Processor shall not engage another processor without prior written authorization of the Controller. A list of authorized sub-processors will be maintained and made available upon request.

6. Data Subject Rights

The Processor shall assist the Controller in responding to requests from data subjects exercising their rights under applicable data protection laws.
